These Terms and Conditions of Use ("Terms") govern your access to and use of the website, digital tools, online forms, and any other digital services made available by Cesan Elektrikli Vinç ("CESAN," "we," "us," or "our") at this domain and any related subdomains (collectively, the "Site" or "Digital Services").

By accessing or using the Site, you ("User," "you") agree to be bound by these Terms. If you do not agree, you must discontinue use of the Site immediately. These Terms apply to all visitors, including corporate representatives, engineers, procurement professionals, and any other person browsing the Site on behalf of a business.

1. Acceptance of Terms

1.1. Your use of the Site constitutes acceptance of these Terms in full. If you are accessing the Site on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

1.2. These Terms apply specifically to your use of the Site and Digital Services. They are separate from, and do not govern, any commercial sales contract, quotation, or order for cranes, hoists, or related equipment, which are instead governed by CESAN's separate Terms and Conditions of Sale, agreed between the parties at the point of order.

1.3. CESAN may update these Terms at any time as described in Section 15.6. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility & Use of the Site

2.1. The Site is intended for business and professional use by individuals and entities operating in industries relevant to lifting, handling, and crane systems. It is not directed at, and should not be used by, individuals under the age of 18.

2.2. You agree to provide accurate, current, and complete information when using any form, inquiry tool, or contact feature on the Site, and to update such information as necessary.

2.3. You are responsible for maintaining the confidentiality of any credentials, if applicable, used to access restricted areas of the Site, and for all activity occurring under your access.

3. Website Content & Information

3.1. The content on the Site — including product descriptions, technical specifications, load charts, drawings, images, case studies, and articles — is provided for general informational purposes only.

3.2. While CESAN takes reasonable care to keep information accurate and up to date, technical specifications, capacities, dimensions, and certifications may change without notice and may vary depending on project-specific engineering. Information published on the Site does not constitute a binding offer, quotation, or guarantee of product specification. Binding technical and commercial terms are established only through a formal quotation and signed order confirmation.

3.3. Any pricing, lead time, or capacity information referenced on the Site is indicative only and subject to confirmation by CESAN's sales and engineering teams.

4. Acceptable Use

4.1. You agree not to use the Site to:

• Violate any applicable law, regulation, or third-party right;
• Upload or transmit viruses, malware, or any code intended to disrupt or damage the Site or its infrastructure;
• Attempt to gain unauthorized access to any part of the Site, server, or database connected to it;
• Use automated tools (bots, scrapers, crawlers) to extract data from the Site without prior written consent, other than standard search engine indexing;
• Interfere with the proper functioning of the Site or impose an unreasonable load on its infrastructure;
• Misrepresent your identity or affiliation, or impersonate CESAN, its employees, or representatives;
• Submit false, misleading, or fraudulent information through any inquiry, quote, or contact form.

4.2. CESAN reserves the right to investigate and take appropriate action, including restricting access, against any User reasonably suspected of violating this Section.

5. Intellectual Property

5.1. All content on the Site — including the CESAN name, logo, trademarks, text, graphics, photographs, technical drawings, videos, software, and the overall layout and design — is the property of CESAN or its licensors and is protected under applicable copyright, trademark, and intellectual property laws.

5.2. You are granted a limited, non-exclusive, non-transferable, revocable license to access and view the Site content for your own internal business evaluation purposes only.

5.3. You may not reproduce, distribute, modify, publicly display, create derivative works from, sell, or otherwise exploit any content from the Site without CESAN's prior written consent, except for reasonable personal reference (e.g., printing a single copy of a published datasheet for internal evaluation).

5.4. Nothing on the Site grants you any license or right to use CESAN's trademarks, trade names, or logos in connection with any product, service, or publication without separate written authorization.

5.5. You may not use, copy, download, or repurpose any product photographs, videos, technical drawings, brochures, case studies, or other media from the Site for your own marketing, advertising, resale listings, social media, or promotional materials — whether or not you are a distributor, reseller, agent, or installer of CESAN equipment — without CESAN's prior written authorization.

5.6. Authorized distributors and resellers may only use CESAN's name, logo, trademarks, and supplied marketing materials strictly in accordance with a separate written distributor/reseller agreement, and solely to promote genuine CESAN Products actually supplied by CESAN. Any such authorization is non-exclusive, revocable, and does not extend to implying an employment, partnership, joint venture, or agency relationship beyond what is expressly agreed in writing.

5.7. Use of CESAN's name, brand, or imagery to market, advertise, or imply endorsement of products not manufactured or supplied by CESAN, or in a misleading, unauthorized, or unflattering manner, is strictly prohibited and may result in legal action, including claims for trademark infringement, unfair competition, and damages.

5.8. If you become aware of any unauthorized use of CESAN's name, trademarks, photographs, or other content by a third party, please report it to cesan@cesan.com.

6. Forms, Quote Requests & Inquiries

6.1. Submitting a contact form, quote request, or technical inquiry through the Site does not create any binding obligation on CESAN to supply Products or Services, and does not constitute an order or contract.

6.2. CESAN aims to respond to inquiries within a reasonable timeframe but does not guarantee any specific response time through the Site.

6.3. Any technical or project information you submit through the Site (load requirements, drawings, site data) may be used by CESAN solely for the purpose of preparing a quotation or responding to your inquiry, subject to our Privacy Policy.

7. Third-Party Links & Services

7.1. The Site may contain links to third-party websites, social media platforms, or services (e.g., LinkedIn, YouTube, mapping services) that are not owned or controlled by CESAN.

7.2. CESAN has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. Accessing such links is at your own risk.

7.3. Inclusion of a third-party link does not imply endorsement, affiliation, or sponsorship by CESAN unless expressly stated.

8. Disclaimers

8.1. The Site and all Digital Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by applicable law.

8.2. CESAN does not warrant that the Site will be uninterrupted, secure, free of errors, or free of viruses or harmful components.

8.3. Any reliance you place on information obtained through the Site is strictly at your own risk. Technical decisions regarding crane selection, capacity, or installation should always be confirmed through formal engineering review and a signed quotation, not solely from Site content.

9. Limitation of Liability

9.1. To the maximum extent permitted by applicable law, CESAN shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your access to, or inability to access or use, the Site or Digital Services, including but not limited to loss of data, loss of business, or loss of profit.

9.2. This limitation applies regardless of the legal theory of liability (contract, tort, negligence, or otherwise), even if CESAN has been advised of the possibility of such damages.

9.3. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory provisions of applicable law, including liability for death or personal injury caused by proven negligence, fraud, or willful misconduct.

9.4. This Section governs liability relating to use of the Site only. Liability relating to the supply of physical Products and engineering services is governed exclusively by CESAN's separate Terms and Conditions of Sale.

10. Indemnification

You agree to defend, indemnify, and hold harmless CESAN, its officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of: (i) your violation of these Terms; (ii) your misuse of the Site; or (iii) any content or information you submit through the Site that infringes a third party's rights or applicable law.

11. Privacy & Cookies

11.1. Your use of the Site is also governed by CESAN's Privacy Policy, which describes how personal data submitted through the Site is collected, used, and protected in accordance with the Turkish Personal Data Protection Law (KVKK) and applicable regulations.

11.2. The Site uses cookies and similar technologies for essential functionality and analytics purposes, as described in the Privacy Policy and any applicable cookie consent notice presented on the Site.

12. Availability & Modifications to the Site

12.1. CESAN reserves the right, at its sole discretion and without prior notice, to modify, suspend, or discontinue any part of the Site or Digital Services, temporarily or permanently, including specific features, tools, or content.

12.2. CESAN is not liable to you or any third party for any modification, suspension, or discontinuation of the Site or any part of it.

13. Suspension of Access

13.1. CESAN reserves the right to restrict, suspend, or terminate your access to the Site, without notice, if it reasonably believes you have violated these Terms, engaged in fraudulent activity, or posed a security risk to the Site.

13.2. Sections of these Terms that by their nature should survive termination of access (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) shall continue to apply after your access ends.

14. Governing Law & Dispute Resolution

14.1. These Terms shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of law principles.

14.2. Any dispute arising out of or relating to your use of the Site or these Terms shall be submitted to the exclusive jurisdiction of the İstanbul (Anadolu) Courts and Enforcement Offices, Republic of Türkiye, unless otherwise required by applicable mandatory consumer or local law.

15. General Provisions

15.1 Entire Agreement

These Terms, together with the Privacy Policy and any applicable cookie notice, constitute the entire agreement between you and CESAN regarding use of the Site, superseding any prior agreements relating to the same subject matter.

15.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 No Waiver

CESAN's failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.

15.4 Relationship to Sales Contracts

These Terms govern use of the Site and Digital Services only. They do not amend, supersede, or apply to any separate commercial sales contract or Terms and Conditions of Sale entered into between CESAN and a Customer for the purchase of equipment or services.

15.5 Assignment

You may not assign or transfer any rights granted to you under these Terms. CESAN may assign its rights and obligations under these Terms without restriction.

15.6 Amendments

CESAN may revise these Terms at any time by updating this page. The "Last Updated" date at the top of this page indicates when the Terms were last revised. Material changes will, where appropriate, be highlighted on the Site.

15.7 Language

These Terms may be made available in multiple languages for convenience. In the event of any discrepancy, the Turkish-language version shall prevail.
